Case No. 26 of 2025, corresponding to Special POCSO Case No.59 of 2025, for the offence registered under Sections 137(2), 87 & 3(5) of the B.N.S., 2023 and cognizance taken under Sections 137(2), 87 & 3(5) of the B.N.S. and Section 4 of the POCSO Act, pending in the court of Sri Asif Equbal, learned Additional District Judge-III-cum-Special Judge, POCSO Act, Hazaribag. Petitioner is alleged to have enticed the daughter of the informant with an intention to marry her. Statement of the victim was recorded under Section 183 of the BNSS, in which, she has stated that she has left her lawful guardianship according to her own wish. She has also stated that petitioner had forcibly established physical relationship with her. The age of the victim is assessed to be 16 years old. Considering the fact that petitioner forcibly established physical relationship with a minor girl, I am not inclined to release the petitioner, on bail.
