HON'BLE MR. JUSTICE PRAVEER BHATNAGAR
Order 11/08/2025
1. The instant bail application has been filed under Section 483 of B.N.S.S. on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No.331/2024, registered at Police Station Civil Lines, District Ajmer, for the offence(s) under Sections 420, 467, 468, 471 and 120-B of IPC.
2.
Learned counsel for the petitioner submits that the accused- petitioner has falsely been implicated in this case. It is contended that the petitioner has neither forged any document nor was the beneficiary in the agreement executed between Abbas and the complainant. Similarly, in the agreement executed between the Anil George and Abbas, the petitioner was only the witness and the petitioner did not had the knowledge that Anil George was not
[2025:RJ-JP:30994] (2 of 3) [CRLMB-7721/2025] the owner of the property. The said property was sold by Anil George to Abbas and subsequently the property was sold to the complainant. The accused-petitioner is in custody since 09.04.2025 and trial of the case may take considerable time, therefore, the bail application of the accused-petitioner may be allowed.
3. Learned Public Prosecutor as well as learned counsel appearing on behalf of the complainant have vehemently opposed the grant of bail application. It is contended that in both the agreements the petitioner was the witness and the said agreement was executed on wrong assertions. The petitioner in collusion with Anil George and Abbas has wrongfully sold the property to the complainant, therefore, the bail application of the accused-petitioner may be dismissed.
4. Heard and perused the material available on the record.
5. It is not desirable to express anything on the merits of the case. The petitioner was only the witness to the agreement executed between Abbas and the complainant. It is not alleged against the petitioner that he wrongfully sold the property rather the main allegations are against Abbas, therefore, considering the above facts, this Court deems it proper to enlarge the accused- petitioner on bail.
6. Accordingly, the bail application under Section 483 of B.N.S.S. is allowed and it is ordered that the accused petitioner- Ajay Choudhary S/o Naimsingh Choudhary, in connection with FIR No.331/2024, registered at Police Station Civil Lines, District Ajmer, shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of
[2025:RJ-JP:30994] (3 of 3) [CRLMB-7721/2025] Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the Court concerned on all the dates of hearing and as and when called upon to do so.
