This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.110/2025 registered at Police Station – Gundardehi, District-Balod (C.G.) for the offences punishable under Section 420 of IPC. 2. As per Case of the prosecution on a written complaint made by the complainants alleging that from 20.06.2021 to 19.12.2023 VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2025.05.14 11:48:15 +0530 2 the applicant has taken Rs. 14,00,000/- (Fourteen Lakh Rupees) from different peoples in the name of providing government job in the office of various Janpad Panchayats of Chhattisgarh on posts such as Computer Operator, Clerk, Peon etc and when the complainants asked for return of their monies the applicant refused and threatened them. 3. Learned counsel for the applicant submits that the applicant is innocent and he has been falsely implicated in the present case. He would submit that the present applicant having no involvement in the aforesaid crime, on two earlier occasions the same allegations by the same complainant has been levlled agaisnt the applicant, however, the SHO of Police Station Ranchirai, Balod has enquired into the matter and submitted its report to the Superintendent of Police on 04.03.2024 and the SP on 31.12.2024 came to the conclusion that no cognizable offence has been committed. However, the police in the instant crime has taken recourse of Section 155 of CrPC and registered the present FIR, therefore, he submits that the present applicant is entitled to be released on anticipatory bail. 4. On the other hand, learned State counsel opposes the prayer for grant of anticipatory bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts & circumstances of the case, gravity of offence, whereby the applicant has taken Rs. 14,00,000/- 3 (Fourteen Lakh Rupees) from different peoples in the name of providing government job in the office of various Janpad Panchayats of Chhattisgarh on posts such as Computer Operator, Clerk, Peon etc, as such, I am not inclined to grant anticipatory bail to the applicants. 7. Accordingly, the anticipatory bail application of the applicant– Surya Prakash Dviwedi, filed under Section 482 of Bhartiya Nagarik Suraksha Sanhita, 2023 involved in Crime No.110/2025 registered at Police Station – Gundardehi, District-Balod (C.G.) for the offences punishable under Section 420 of IPC, is rejected.
