Learned counsel for the appellant submitted that two co-accused, namely Dhiraj Kumar Sharma and Upendra Kumar Singh, have been granted anticipatory bail vide orders dated 01.12.2023 and 15.07.2024 passed in Cr. Appeal (S.J.) No.563 of 2023 and Cr.Appeal (S.J.) No.812 of 2023 respectively, by the Co-ordinate Bench (Hon’ble Mr. Justice Rajesh Kumar) of this Court, however, from going through the record it appears that earlier the Anticipatory Bail of this appellant has been withdrawn before the Co- ordinate Bench (Mr. Justice Ambuj Nath, as then His Lordship was) of this Court vide Criminal Appeal (S.J.) No. 842 of 2023, which is mentioned in Paragraph No. 2 of this appeal.

In view of the above, learned counsel for the appellant seeks permission to withdraw this Criminal Appeal.

None appears for the State.

Permission is granted.

Accordingly, this Criminal Appeal (S.J.) No. 116 of 2025 is dismissed as withdrawn.

The Interim Order dated 05.08.2025 passed by this Court shall stand vacated.

The appellant is directed to surrender before the learned Court below, however, the Court below will not be prejudiced by the order passed by this Court and will consider the prayer of the appellant sympathetically in view of the fact that other co-accused persons have been granted anticipatory bail by the Co-ordinate Bench of this Court.
