163 2211..0055..22002255 Ct. No. 18 adeb W.P.A. 9527 of 2025 Kakali Shit Vs. The State of West Bengal & Ors. Mr. Shuvro P. Lahiri Mr. Rajesh Naskar Ms. Indrani Roy Mr. Ankan Mondal …for the Petitioner Ms. Munmun Tewari …for the State Mr. Ranjan Saha .. for the DPSC, Paschim Medinipur Affidavit of service filed on behalf of the petitioner is taken on record. Petitioner being a primary teacher working in a school in Paschim Medinipur has prayed for transfer by making offline application on 4th March, 2025. The ground which was been assigned for transfer is distance in between the present school of the petitioner and her place of residence. Additionally it is also stated that child of the petitioner is suffering from autism. District Primary School Council, Paschim Medinipur and State respondents are represented by learned advocates. 2 However, on perusal of the writ petition it appears that no application has been made to the Chairman, District Primary School Council, Paschim Medinipur seeking transfer. Leave is granted to the petitioner to make application for transfer in offline mode by fortnight from date. If such application is made within the aforesaid time Chairman, District Primary School Council, Paschim Medinipur being respondent no. 6 is directed to decide the transfer application in accordance with law by 6 (six) weeks thereafter and the decision to be taken by respondent no. 6 shall be communicated to the petitioner by fortnight thereafter. It is made clear that suspension of portal shall not be a ground to reject transfer application of the petitioner. Writ petition stands disposed of. Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking. (Saugata Bhattacharyya, J.)
