Present C528 application has been filed by the applicant along with the compounding application (IA/1/2025) for quashing the charge-sheet, summoning order dated 23.12.2024 as well as the entire proceedings of Criminal Case No.716 of 2024, State vs. Suraj Rawat, under Sections 420, 468, 471 IPC, pending in the court of learned Judicial Magistrate, Kashipur, District Udham Singh Nagar on the basis of compromise entered into between the parties. 2. Along with C528 application, a joint compounding application (IA No.1/2025) has also been moved by the parties, supported by their separate affidavits. It is stated in the compounding application 1 2025:UHC:932 that applicants and the private respondents are have settled the dispute amicably and the private respondents do not want to pursue with the present case, in view of the compromise entered into between them. 3. Today applicant (Suraj Rawat), respondent no.2 (Deepak Rawat), respondent no.3 (Raman Rawat) are present before this Court duly identified by their respective Advocates. 4. Since the parties have entered into compromise, therefore, there is no useful purpose for keeping this criminal case pending and it will be a futile exercise to ask the applicant to appear before the trial court as accused to face the trial. 5. Accordingly, the compounding application (IA No.1/2025) is allowed in terms of the compromise entered into between the parties terms whereof have been narrated in the compounding application. 6. Consequently, the summoning order dated 23.12.2024 as well as the entire proceedings of Criminal Case No.716 of 2024, State vs. Suraj Rawat, under Sections 420, 468, 471 IPC, pending in the court of learned Judicial Magistrate, Kashipur, District Udham Singh Nagar are hereby quashed. Resultantly, the FIR dated 22.05.2024, pursuant to which charge sheet dated 08.09.2024 filed also stand quashed. 7. Office to do the needful. 8. C528 application stands disposed of accordingly.
