P SRAVAN KUMAR REDDY The Court made the following: THE HONOURABLE SRI JUSTICE VENKATESWARLU NIMMAGADDA WRIT PETITION NO:15664/2025 ORDER: The present writ petition is filed under Article 226 of the Constitution of India seeking following relief: “to issue a Writ, Order or Direction more particularly in the nature of a Writ of Mandamus declaring the action of the respondents more specifically the 3rd respondent in deleting the entries in the revenue records by way of proceedings vide Rc.No.D2(B)/640/2019 dated 06.06.2025 as illegal, arbitrary and violative of the fundamental rights guaranteed under Articles 14, 19 and 300-A of the Constitution of India and contrary to the express provisions of the Andhra Pradesh Rights in Land and Pattadar Passbooks Act, 1971. Consequently set aside the same and pass such other and further orders as this Hon’ble Court may deem fit, just and proper in the circumstances of the case, in the interest of justice and equity.” 2. Heard learned counsel for the petitioners and learned Government Pleader for Revenue for the respondents. 3. The case of the petitioners herein is that the unofficial respondents herein preferred an Appeal before the 3rd respondent seeking for deletion of the petitioners’ names from the revenue records. Without obtaining any prior order or direction from the 4th respondent who is the competent authority under the law, the 3rd respondent straight away passed the order dated 06.06.2025 directing the authorities concerned to delete the names of the petitioners’ from the revenue records. Aggrieved by the same, the petitioner herein filed the present writ petition. 4. On the other hand, learned Government Pleader for the respondents submits that since the 3rd respondent already issued proceedings dated 06.06.2025 directing the respondents to delete the names of the petitioners from the revenue records, the petitioners are under statutory obligation to file a revision before the respondent No.2 herein challenging the proceedings dated 06.06.2025. 5. Having regard to the submissions made by the learned counsel for the petitioners and learned Government Pleader for the respondents and on perusal of the material placed on record, this Court is of the considered view that the present writ petition can be disposed of, directing the petitioners herein to file a Revision before the respondent No.2, within a period of three (03) weeks from the date of receipt of a copy of this order. On receipt of such Revision, the respondent No.2 shall consider and dispose of the same, in accordance with law, within a period of six (06) months, thereafter. Till then, Status Quo obtaining as on today shall be maintained by all the parties concerned in respect of the revenue entries as well as possession of the subject property. 6. With the above directions, the writ petition is disposed of. There shall be no order as to costs.
