1. Sri. Siddharth Baburao, learned Additional Government Advocate is directed to take notice for the respondent Nos.1, 2 and 3. 2. In this writ petition, petitioner is assailing the order dated 06.02.2024 (Annexure-L) passed by respondent No.1. 3. Heard learned counsel appearing for the parties. - 3 -

Having taken note of the submissions made by learned counsel appearing for the petitioner and the learned Additional Government Advocate, it is noted that, petitioner herein has challenged the entry in M.R.H.No.30/2011-12 before respondent No.2, wherein the entry has been made in favour of respondent No.4 herein. The respondent No.2, as per order dated 23.02.2022 (Annexure-H) allowed the appeal in part and accordingly, quashed the M.R.H.30/2011-12 dated 07.06.2012, passed by the Tahsildar - respondent No.3 herein. Feeling aggrieved, the respondent No.4 herein has filed R.P.No.54/2022 before respondent No.1. The respondent No.1, after considering the material on record, vide order dated 06.02.2024 (Annexure-L), accepted the revision petition filed by respondent No.4 herein and directed the parties to await the result in O.S.No.3348/2016. 5.
In the backdrop of these aspects, wherein the petitioner herein claims right in respect of the land in question on the ground that original grantee is the uncle of the petitioner herein. The respondent No.4 herein is claiming right in respect of the subject land as per Will dated 29.12.2009. In that view

of the matter, taking into consideration that rights of the parties is required to be adjudicated in O.S.No.3348/2016, I am of the view that, no interference is called for in this writ petition. 6. Accordingly, the writ petition is rejected. However, it is open for the petitioner to approach the competent authority after the conclusion of the aforesaid suit, before the competent forum, if so necessitated. Sd/- (E.S.INDIRESH) JUDGE
