W.P.No.17138 of 2025 has been filed by present appellants/writ petitioners for setting aside notice dated 04.07.2025, issued under Sections 405 & 406 of the Andhra Pradesh Municipal Corporation Act, 1955 (for short, ‘APMC Act’), whereby writ petitioners have been called upon to remove alleged unauthorized sheds on the site earmarked as layout open space within a period of seven days. 2 W.A.No.796 of 2025 & C.C.No.1923 of 2025 2. Various grounds, it is submitted, had been raised in writ petition qua grant of interim relief in their favour. Present writ appeal was filed when interim relief was not afforded. Notice was issued in this writ appeal on 10.07.2025 and it was directed that status quo be maintained with regard to possession on spot. 3. Learned counsel for respondent No.2 submits that copy of order dated 10.07.2025 was received in tappal section on 14.07.2025 and placed before Additional Commissioner in the afternoon of 15.07.2025, however, unauthorized sheds had by then been removed during morning hours of 15.07.2025, leading to filing of Contempt Case vide C.C.No.1923 of 2025. 4. It is further informed that W.P.No.17138 of 2025 is pending adjudication, though it is not listed on any particular date as of now. 5. During the course of arguments, it is agreed that arguments in writ petition itself shall be addressed at the earliest and no adjournment shall be sought by any of the parties and till then status quo as on today be maintained. 6. Learned counsel for appellant/writ petitioner submits that in view of given facts and circumstances, he has instructions not to press the contempt petition. 3 W.A.No.796 of 2025 & C.C.No.1923 of 2025 7. Keeping in view facts and circumstances as above and consensus arrived at between parties, it is directed that W.P.No.17138 of 2025 be listed for hearing before learned Writ Court having roster on 28.07.2026. Status quo as on today be maintained till decision of said writ petition. 8. W.A.No.796 of 2025 is accordingly disposed of and C.C.No.1923 of 2025 is disposed of as not pressed. No costs.
