Today when the petition is taken up for hearing, learned Assistant Public Prosecutor has produced a copy of instructions dated 07.01.2025, of the Inspector of Police, Srikakulam II Town Police Station, Srikakulam District, wherein it is stated that pending the present petition, the Police, after due investigation on 10.10.2020, have filed a charge sheet vide C.C.No.249 of 2020 on the file of the Additional Judicial First Class Magistrate Court, Srikakulam, and the case is in pre-trial stage. 3. In view of the fact that a charge sheet vide C.C.No.249 of 2020 has already been filed on 10.10.2020, pending the present petition, learned counsel for the petitioner sought permission of this Court to withdraw the present petition. 4. Permission as sought for is accorded. Accordingly, this criminal petition is dismissed as withdrawn, with a liberty to challenge the aforementioned charge sheet, if at all the petitioner is aggrieved by the same.
