This application has been filed under Section 430(1) of the Bharatiya Nagarik Suraksha Sanhita, 2023 praying for suspension of sentenced imposed upon the present petitioner by the learned Chief Judicial Magistrate Lakhimpur at North Lakhimpur in C.R. (Excise) No.02/2018 vide Judgment and Order dated 02.01.2020. I have gone through the Judgment and I have also considered the submissions made by learned counsel for both the sides. The sentence imposed upon the petitioner on 02.01.2020 by the learned Chief Judicial Magistrate Lakhimpur at North Lakhimpur in C.R. (Excise) No.02/2018 shall remain suspended till disposal of the connected appeal. The applicant Sri. Prabhat Gogoi is allowed to go on bail of Rs.20,000/- with a Page No.# 3/3 surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Lakhimpur at North Lakhimpur.
