“a. That, the Hon'ble Court may kindly be pleased to suitably direct the Respondent to consider the petitioner's transfer as per the Transfer policy at her own cost at Mungeli preferably at NPEGEL Govt. Primary School Karhi Block Mungeli. b. Any other relief, order/direction may be pleased to issue in the facts and circumstances of the case.” 2 Since no one appears on behalf of the petitioner when the matter is taken up for consideration, this Court proceeds to examine the record available. From perusal of the same, it appears that the grievance of the petitioner essentially pertains to the alleged inaction on the part of the respondent authorities in not considering her request for inter-district transfer from Kabirdham to Mungeli, made on the ground that she herself is a physically challenged person having 70% disability, and further that her minor son is suffering from Dystonia/Cerebral Palsy and requires continuous medical treatment at District Hospital, Mungeli. The petitioner had made repeated representations before the authorities seeking transfer, even at her own cost, but her request was not acceded to, which has led her to file the instant writ petition. It is also relevant to note that, as on date, there is no interim order operating in favour of the petitioner.
3 In these circumstances, and taking into account the subsequent developments, this Court is of the considered view that the relief
3 sought in the writ petition does not survive for adjudication and the same has been rendered infructuous. 4 Accordingly, the writ petition stands dismissed as having been rendered infructuous. However, liberty is reserved in favour of the petitioner to make a fresh representation, if so advised. 5 No order as to costs. Sd/-
