CORAM: HON'BLE MR JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused No.1 in Spl.C.C.No.486/2022 pending before the Court of XXXIII Additional City Civil and Sessions Judge and Special Judge (NDPS), Bengaluru, arising out of Crime No. FR.No.DRI/BZU/S-IV/ENQ-27 (INT-NIL) 2021 registered by the Directorate of Revenue Intelligence, Bengaluru Zonal Unit, Bengaluru, for offence punishable under Sections 20(b)(ii)(C), 28 and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'NDPS Act') is before this Court in this successive bail application filed under Section 439 of Cr.PC seeking regular bail.

Learned Counsel for the petitioner submits that petitioner had earlier approached this Court in

HC-KAR NC: 2025:KHC:22435 CRL.P No. 4140 of 2025 Crl.P.No.6868/2024 and the said petition was disposed of with a direction to the learned Special Judge to conclude the trial on or before 20.12.2024, considering the fact that petitioner is in custody from 22.08.2021. He submits that case is not disposed of even after a lapse of six months. Accordingly, he prays to allow this petition.

Per contra, learned Counsel for respondent who has filed his statement of objections, submits that prosecution has already closed its side of evidence and the case is now posted for recording the statement of the accused under Section 313 of Cr.PC. The trial Court may be directed to conclude the trial and dispose of the case on merits within a period of two months.

Submissions made on both side is placed on record.
5. This Court while disposing of Crl.P.No.6868/2024 by order dated 24.10.2024 had directed the trial Court to conclude the trial as earlier as possible by posting the case

20.12.2024. Even after a lapse of six months from the time granted by this Court to dispose of the case, the case has been not disposed of.
6. However considering the fact that case is at the stage of recording the statement of accused under Section 313 of Cr.PC, the trial Court is directed to dispose of the case as expeditiously as possible, but not later than a period of two months from today.
