This writ petition has been filed seeking issuance of writ of mandamus commanding the respondents to take immediate steps for “Selection” and issuance of “Work Order to the Petitioner Group”. 2. The petitioner claims to be the Secretary of a Self Help Group, named Alor Pathe. It is the petitioner’s assertion that in the year 2016-17, the petitioner had been awarded the contract of providing school uniforms to the students of Primary and High Schools under the Khakurdaha Gram Panchayat area on the basis of a tender process initiated by the respondents where the petitioner came out successful. It is the petitioner’s case that thereafter the respondent authorities have been awarding a contract to Self Help Groups arbitrarily without initiation of any tender process. 2 3. Learned advocate appearing for the respondent State authorities submits that since 2022 onwards selection of Self Help Group for the purpose of preparing School Uniforms is being done in terms of the resolutions taken in the meeting of the Block Level Monitoring Committee following Standard Operating Procedure set by the Government of West Bengal. It is submitted that the petitioner’s application for such purpose could not be considered inasmuch as the petitioner’s application was made on January 17, 2025 but the Block Level Monitoring Committee Meeting was held on prior to that i.e. on November 21, 2024. Copy of instructions handed up to court by the leaned advocate appearing for the state respondent is taken on record. 4. From the statements made in the writ petition, it is evident that same is restricted to the petitioner’s prayer for issuance of work order for preparation of School Uniform in terms of the petitioner’s request for the year 2025, however, since the said academic year has already elapsed such prayer cannot be considered at this moment. The petitioner shall however be free to make appropriate representation before the respondents for the purpose of preparing and providing School Uniforms for the Primary as well as the High Schools under the Said Gram Panchayat for the present academic year. The 3 appropriate authority shall consider the petitioner’s representation and take appropriate decision, in accordance with law. 5. With the aforesaid observations, WPA 4911 of 2025 stands disposed of. No costs. 6. Urgent certified photocopy of this order, if applied for, be supplied as expeditiously as possible.
