IN THE HIGH COURT OF JHARKHAND AT RANCHI A.B.A. No.5143 of 2024 ------ Devanand Yadav @ Dewanand Yadav, son of Babulal Yadav, resident of village Purnadih, PO and PS Naitanr, District Giridih … … Petitioner(s) Versus The State of Jharkhand. … … Opposite Party(s) ------
CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Prabhat Kr. Sinha, Advocate.
Mr. S. Singh, Advocate For the State : Mr. P.D. Agrawal, A.P.P. For the Informant : Mr. Vijay Kumar Roy, Advocate ----- 07/ 17.06.2025 Heard the parties.
2. This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioner apprehending his arrest for offences registered under Sections 147/149/341/323/324/307/504/506 of the Indian Penal Code pending in the Court of learned ACJM, Giridih in connection with Dumri PS Case No. 19 of 2023.
3.
Learned counsel for the petitioner submits that the petitioner is a student and after 15 days FIR has been lodged. He submits that the victim was taken to several hospitals but his statement was not recorded.
4. Learned A.P.P. representing the State opposes the prayer for anticipatory bail and produces the case diary especially injury report which suggests that there is injury in the occipital region.
5. After going through the FIR, I find that there is direct allegation against this petitioner that he had assaulted the

victim by cricket bat.
6. Considering the nature of the allegation, this Court finds it not a fit case for grant of anticipatory bail to the petitioner.
7. Accordingly, this Anticipatory Bail Application stands dismissed.
8. The petitioner should appear before the court concerned. On his appearance his case will be considered on its own merits without being prejudice by the order of this Court.
