1. After hearing arguments for some time, learned counsel for applicant, without prejudice to his rights and contentions, does not press the present application at this stage and seeks to withdraw, with liberty to file it afresh at a later stage.
2. He, however, submits that though the prosecution has already examined three witnesses but the complainant has so far not entered into witness box and let there be a request to learned Trial Court to expedite recording of her deposition.
3. Learned APP for the State assures that requisite steps would be taken to ensure her presence before the learned Trial Court and IO would also make appropriate request in this regard before the learned Trial Court tomorrow itself.
4. In view of the above, application stands disposed of in aforesaid terms.
5. All rights and contentions of the parties are reserved.
6. Learned Trial Court is requested to expedite the recording of deposition of complainant.
7. Needless to say, applicant would be at liberty to approach this Court again once the testimony of the complainant is recorded.
