Learned Counsel for the petitioner after arguing the matter for sometime, submits that petitioner was earlier granted anticipatory bail by the Court of LXIX Addl. City Civil & Sessions Judge, Bengaluru City, in Crl. Misc. No.11773/2019 disposed of on 10.01.2020. However, thereafter he had not furnished necessary sureties in compliance of the conditions imposed by the Sessions Court in Crl. Misc. No.11773/2019. He submits that petitioner is ready and willing to surrender before the Trial Court and seek regular bail. Considering the aforesaid aspect of the matter and since the petitioner has no other criminal antecedents, his regular bail application may be directed to be considered on merits by the Trial Court on the same day. 2. The aforesaid submissions are placed on record. However, learned HCGP has opposed the prayer of the petitioner. 3. The material on record would go to show that on the merits of the case, petitioner was granted anticipatory bail in this case by the jurisdictional Sessions Court in Crl. Misc. - 3 - NC: 2025:KHC:14819 CRL.P No. 4505 of 2025 No.11773/2019 disposed of on 10.01.2020. Undisputedly, petitioner has no other criminal antecedents. Considering the aforesaid aspects of the case, I am of the opinion that if the petitioner surrenders before the Trial Court and makes necessary application seeking regular bail, the said application shall be considered on merits and disposed on the same day.
