ORAL ORDER
Accused No.3 in Crime No.42/2018 registered by Halasur Police Station, Bengaluru City, for offence punishable under Sections 307 read with Section 34 of IPC is before this Court under Section 439 of Cr.PC seeking regular bail.
2. Heard.
3. FIR in Crime No.42/2018 was registered by Halasur Police Station, Bengaluru City, for the aforesaid offence against Rohith and others, based on the first information dated 24.01.2018 received from Murugesh S/o Late.Narayanaswamy, who is the father of injured victim Sharath Kumar.
4. Petitioner's name is not found in the FIR that was registered against three named persons and others. He was arrested on 06.12.2024 and subsequently remanded

to judicial custody. After completing investigation, charge sheet has been filed against three persons and accused No.1 in the charge sheet is a juvenile. Bail application filed by the petitioner before the Jurisdictional Sessions Court in Crl.Misc.No.25183/2025 was rejected on 11.03.2025. Therefore, petitioner is before this Court.

As per the charge sheet allegation, accused Nos.1 to 3 had fought with the injured Sharath Kumar at about 8:00 pm on 24.01.2018 on a petty issue and allegation of assaulting the injured on his stomach with a knife is as against accused No.1 who is a juvenile. Accused Nos.2 and 3 allegedly had assaulted the injured C.W-2 with a knife on his right thigh.
6. Wound Certificate of injured C.W-2 would go to show that out of three injuries suffered by him, the injury found on his stomach is considered as a grievous injury and the other two injuries are certified as simple injuries. The injury found on the stomach of the victim is corresponding to the assault made by accused No.1.

Undisputedly, petitioner herein has no other criminal antecedents and he is in custody from 06.12.2024. Under the circumstances, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively. Accordingly, the following:
ORDER
The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.42/2018 registered by Halasur Police Station, Bengaluru City, for offence punishable under Sections 307 read with Section 34 of IPC, subject to the following conditions: a) The petitioner shall execute personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons;

c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
