Singh, learned counsel appearing for the petitioner as well as Mr. D. P. Goswami, learned Additional Public Prosecutor appearing for the State of Assam. 2. This is an application under Section 483 of the BNSS, 2023, whereby the petitioner, Sri Banjit Barman has prayed for releasing him on regular bail, after he was arrested in connection with Tihu P.S. Case No.56/2024 under Section 80(2) of the BNS, 2023. Page No.# 2/2 3. One person has lodged an FIR before police alleging that her niece was given marriage with the present petitioner. She says that after some days of marriage, her niece was subjected to physical and mental torture for want of dowry. According to informant, she was informed about those things by her niece. The informant has alleged that the physical and mental torture was meted out to her niece by the present petitioner compelling her to commit suicide by consuming poison. 4. Mr. Singh has submitted that the deceased lady was maintaining relationship with her cousin brother and on 10.10.2024, both of them were caught red-handed in a compromised position. 5. Mr. Goswami has submitted that one person has stated before police about the said things. 6. I have considered the submissions made by the learned counsels of both sides. 7. Under the given circumstances of the case, this Court is of the opinion that the petitioner does not deserve to be detained in custody. 8. Accordingly, the bail application of the petitioner is allowed. 9. It is hereby directed that the petitioner, Sri Banjit Barman, who was arrested in connection with Tihu P.S. Case No.56/2024, shall be released on bail of ₹20,000/- with a surety of like amount to the satisfaction of the learned Judicial Magistrate, 1st Class, Tihu.
