SATAPATHY Order No. ORDER(ORAL) 23.04.2026 05. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode). 2. Since these two bail applications arise out of one and same case record, the same are heard together and disposed of by this common order with the consent of the learned counsel for the parties. 3. These are the bail applications U/S.483 of BNSS by the petitioners for grant of bail in connection with Kalimela PS Case No.22 of 2025 corresponding to Spl. GR Case No.25 of 2025 pending in the file of learned Addl. Sessions Judge-cum-Special Judge, Malkangiri for commission of offences punishable U/Ss.20(b)(ii)(C) of the NDPS Act, on the main allegation of possessing 150 Kgs of Contraband Ganja. 4. Heard, Mr. Mangu Nandy, learned counsel for the Petitioner in BLAPL No. 11537 of 2025; Mr. Arshit Behera, learned counsel for the Petitioner in BLAPL No. 13539 of p. 2 2025 and Mr. P. Satpathy, learned Addl. PP in the matter and perused the record. 5. After having considered the rival submissions and taking into consideration the nature and gravity of the offences as alleged against the petitioners vis-à-vis the allegation sought to be brought against them and regard being had to the recovery and seizure of 150Kgs of Contraband Ganja, which is well above the commercial quantity allegedly from the possession of the petitioners and their consequent failure to satisfy the conditions of Sec. 37 of NDPS Act, this Court is not inclined to grant bail to the Petitioners. Hence, these two bail applications of the petitioners stand rejected. Accordingly, these BLAPL Nos.11537 and 13539 of 2025 stand disposed of. A soft copy of this order be immediately transmitted to the learned trial Court. (G. Satapathy) Judge Priyajit
