The petitioner has been made an accused in connection with S.T. No. 82 of 2022 arising out of Dumka (M) P.S. Case No. 204/2021, corresponding to G.R. Case No. 773 of 2022 for the offences registered under Sections 302/ 34, 201 & 120(B) of the Indian Penal Code subsequently charge has been framed under Sections 376(D), 302/34, 201/34 & 120B of the I.P.C., pending in the Court of learned Additional Sessions Judge-II, Dumka. 3. Bail application of the petitioner was earlier rejected by this Court vide B.A. No. 3739/2024 by order dated 23.08.2024. 4. Petitioner Panchu Yadav @ Panchanand Kumar Yadav was granted bail earlier by this Court vide B.A. No.2043 of 2022 by order dated 12.04.2022. It appears that the State challenged the order of granting bail to the petitioner in the Hon'ble Supreme Court and the Apex Court had remitted the matter back to this Court directing the petitioner to surrender before the learned trial court and after his surrender to reconsider the matter on merit. It is alleged that petitioner and co-accused persons had murdered the victim after raping her. 5. Considering the nature of allegation, I am not inclined to release the petitioner, on bail.
