Heard Mr. Serto T Kom, learned counsel appearing for the petitioner through VC and Mr. W. Darakishwor, learned Sr. PCCG appearing for the respondent.
The present application has been filed praying for enlarging the petitioner/ accused person on bail in connection with the NCB Crime No. 02/NCB/Imp/2023, dated 03.03.2023 u/s 8 (c) & 9A r/w sec 21(c), 25A, 25 & 29 of the NDPS Act, 1985 and Special Trial No. 26 of 2023 in the Court of Special Judge NDPS Court, Manipur at Imphal.
The learned counsel for the respondent filed affidavit in opposition on behalf of the respondent. In that affidavit, the respondent failed to make out the case that the present petitioner/ accused directly involved in the transaction of the contraband drugs.
On top of that the present petitioner/ accused is languishing in jail which is going to be completed 2 years and considering the allegation made against the present accused/ petitioner in the affidavit in opposition filed by the respondent, the bail application of the accused/ petitioner is allowed with the following conditions: OINAM THOIB A MEITEI Digitally signed by OINAM THOIBA MEITEI Date: 2025.02.28 14:52:27 +05'30'
i. The accused/ petitioner be released on bail on her furnishing PR bond of Rs. 3,00,000/- (Rupees three lakh) only with 1(one) surety (local Government Employee of the State of Manipur) of the like amount to the satisfaction of the arresting authority. ii. The accused/ petitioner should co-operate with the investigation and she should make herself available for interrogation as and when required. iii. The accused/petitioner should not leave the State of Manipur without prior permission of the arresting authority.
It is further, made clear that if the accused/ petitioner violates any of the conditions given hereinabove, the respondent is at liberty to approach this Court for modification or cancellation of this order.
Accordingly, the present Bail Appln. No. 37 of 2024 is disposed of.
