JUSTICE SANJEEV KUMAR SHARMA ORDER 17.03.2026 Heard Mr. Johny L. Tochhawng, learned counsel for the applicant/appellant. This is an application filed for condonation of delay of 273 days in filing the connected Crl. Appeal against the impugned Judgment & Order dated 25.01.2024 passed by the Chief Judicial Magistrate, Champhai in Crl. Comp. No 21/2022. It appears that the respondent No. 1 (acquitted accused) has expired on 21.06.2021 and therefore, the case appeal as against the said respondent No. 1 Page No.# 3/3 has abated. It also appears that the service on respondent Nos. 2 & 3 is also complete but none appears to represent them. Having perused the instant I.A and the reasons stated occasioning the aforesaid delay, which averments are supported by an affidavit, I am of the view that the applicant has sufficiently explained the delay and that the applicant was prevented by sufficient cause from approaching the Court within the period of limitation.
