JUSTICE SANJEEV KUMAR SHARMA ORDER 17.03.2026 Heard Mr. Johny L. Tochhawng, learned counsel for the applicant/appellant. This is an application filed for condonation of delay of 273 days in filing the connected Crl. Appeal against the impugned Judgment & Order dated 25.01.2024 passed by the Chief Judicial Magistrate, Champhai in Crl. Comp. No 21/2022. It appears that the respondent No. 1 (acquitted accused) has expired on 21.06.2021 and therefore, the case appeal as against the said respondent No. 1 Page No.# 3/3 has abated. It also appears that the service on respondent Nos. 2 & 3 is also complete but none appears to represent them. Having perused the instant I.A and the reasons stated occasioning the aforesaid delay, which averments are supported by an affidavit, I am of the view that the applicant has sufficiently explained the delay and that the applicant was prevented by sufficient cause from approaching the Court within the period of limitation. Accordingly, the delay of 273 days stands condoned and the I.A stands The Registry is directed to list the connected Crl. Appeal after 2 (two) weeks. ` JUDGE Comparing Assistant
