To call for the records relating to the proceedings in CC.No.45 of 2021 on the file of the Learned Judicial Magistrate Court,Vadipatti and quash the same as illegal in respect of the Petitioners are concerned. https://www.mhc.tn.gov.in/judis ORDER This petition is filed to quash the CC.No.45 of 2021 on the file of the Judicial Magistrate Court, Vadipatti. 2.The petitioners are Accused Nos.6 to 8 and the defacto complainant is the wife of the 1st accused. There was a matrimonial dispute between the 1st accused and the defacto complainant wife. 3.The specific allegation against the petitioners is that they went to the father in law in order to mediate between the 1st accused and de facto complainant and Accused Nos.2 and 3. FIR was filed against the petitioners under Sections 294(b) and 506(ii) alone and other sections are not against the present petitioners. In the FIR, the defacto complainant has mentioned the name of the petitioners. However, there is no specific overt act against the petitioners. In the 161 statement which was stated by the defecto complainant on 01.02.2016, she has not mentioned the name of the petitioners. Subsequently, when another statement was obtained on 24/08/2018 also, the defacto complainant has not mentioned the petitioners' name. As far as Section 506(ii) is concerned, mere conducting of mediation will not cause alarm. Therefore, the ingredients under Sections 506(ii) is also not attracted. 6.Therefore, this Court is inclined to quash the charge sheet as far as the petitioners are concerned and accordingly, the charge sheet is quashed.
