1. The applicant has preferred this application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’), for grant of anticipatory bail, apprehending his arrest in connection GOURI MUDALIAR Digitally signed by GOURI MUDALIAR Date: 2025.05.13 11:14:47 +0530
2 with Crime No.37/2025, registered at Police Station Sonhat, District Koriya (C.G.) for alleged commission of offence punishable under Sections 351 (3), 64 (2) (M), 69, 89 of Bhartiya Nyay Sanhita.

Case of the prosecution, in brief, is that the victim and applicant came into contact from Instragram on 25-11-2023, the applicant took the victim to the room and established physical relationship with her and when the victim was going to lodge the report, the applicant assured her that he will perform marriage and thereafter the applicant continuously established physical relationship with victim. It is further alleged that when the victim became pregnant, a tablet was given by the applicant to terminate the pregnancy of victim and the applicant established relationship with victim from 25-11-2023 to 06-07-2024.

Learned counsel for the applicant submitted that the victim was having relationship with the applicant and it is a case of consensual relationship but present FIR has been lodged against the applicant with oblique motive, therefore he prays to enlarge the applicant on anticipatory bail.

On the other hand, learned State counsel opposes the prayer for grant of anticipatory bail and she would submit that the applicant and victim came in contact through Instagram, there was physical relationship was also established between them and the victim became pregnant and thereafter she was got aborted by the
3 applicant by giving some medicine and applicant further performed engagement with her on 5/10/2024 and have assured that he will marry her on 20/01/2025 but after two months have lapsed he did not marry her which goes to show that the applicant had betrayed her and established relationship on the pretext of marriage and he has further taken Rs.1,50,000/- from her, therefore the applicant is not entitled for grant of bail.
5. I have heard learned counsel for the parties and perused the case diary.

Considering the facts and circumstances of the case, considering the nature of allegation levelled against the applicant that the applicant and victim came in contact through Instagram, there was physical relationship was also established between them, when victim became pregnant, she was got aborted by the applicant by giving some medicine and applicant further performed engagement with her on 5/10/2024 and have assured that he will marry her on 20/01/2025 but after two months have lapsed he did not marry her which goes to show that the applicant had betrayed her and established relationship on the pretext of marriage and he has further taken Rs.1,50,000/- from her, considering the conduct of the applicant, I am not inclined to grant anticipatory bail to the present applicant.

Accordingly, the anticipatory bail application of the applicant - Atik Siddiqui, involved in Crime No.37/2025, registered at Police Station Sonhat, District Koriya (C.G.) for alleged commission of offence punishable under Sections 351 (3), 64 (2) (M), 69, 89 of Bhartiya Nyay Sanhita is rejected.
