It has been contended by learned counsel for the petitioner that though on the basis of UGC Guidelines which came in 2018, PhD qualification was required for remaining on the post of Assistant Lecturer/Associate, however, in 2023, the said condition of having PhD, has been taken away. 2. It has been further submitted by learned counsel for the petitioner that though he has already represented before the respondents, but they are sitting tight over the matter and they are forcing the petitioner not to join the original post. 3. In reply to the same, learned counsel appearing for BIT, Meshra submits that this writ application may be kept pending and the representation of the petitioner will be considered in view of the fact that BIT, Meshra cannot act contrary to the UGC Guidelines and now there is no post of Associate Lecturer/Associate; as such, some midpoint is to be figured out as a matter of fact, since the petitioner was having an experience in BIT, Meshra and an offer was given to him by giving him contractual promotion, however, if he is not agreeable to that, 2 then some way has to be found out and since his representation is pending, the same shall be considered in accordance with the present rules and regulations of UGC vis-à-vis BIT, Meshra. 4. Having regard to the aforesaid submission, the respondents are directed to take a decision with regard to the grievance of the petitioner and since the petitioner is not getting any salary and is not being allowed to rejoin, as per him; as such, the decision be taken within a period of four weeks. 5.
