The petitioner alleges that the private respondent has raised unauthorized construction without obtaining sanction from the concerned Panchayat. The Pradhan, Kamarkundu-Gopalnagar-Daluigacha Gram Panchayat, being the 3rd respondent herein, has issued a certificate on 8th September, 2025 to the effect that no building permission was granted to the private respondent by the said Panchayat. Learned counsel for the private respondent denies and disputes the allegations made by the petitioner. On prayer of the petitioner, liberty is granted to submit a comprehensive representation in this regard before the 3rd respondent within a week from date. The 3rd respondent is directed to consider and dispose of the same within six weeks from the date of receipt thereof upon affording reasonable opportunity of hearing to all 2 concerned including the petitioner and the private respondent, in accordance with law. The decision taken by the authority shall be communicated to the parties within a week thereof. In the event the construction raised by the private respondent is found to be illegal/unauthorized, the concerned authority shall take necessary steps in accordance with law. The writ petition is disposed of accordingly. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
