A case has been registered against the petitioners and others for the offences under Sections 191(2),191(3),118(1),109(1) read with 190 B.N.S. 3. Case of the prosecution, in brief, is that, on 27.5.2025, at about 10.00 am, at V.Rajupalem village fI'elds, near Penna River, Chapadu Mandal, due to the boundary disputes in between A.1 and informant's uncle, A,1 to A.77 formed themselves into an unlawful assembly armed` with bill-hooks, iron rods and sticks, with the common object of attacking and killing the defacto complaint and his family members, and in Prosecution Of the common Object When the defaCtO COmPIainant and his COuSin N.Pavan were transporting mud into their fI'eldS, all the accused came and picked up quarrel and attempted to attack them, and on coming .rzrf / 3 to know the same, the felative§ of defacto complainant rushed to the fields and tried to convince the accused, but the accused without heeding their words, attacked the defacto complainant and some others with bill- hooks, iron rods and sticks and caused them severe bleeding injuries and contusions, and basing on the report, the case was registered and A1, A3 to A7 were remanded to judicial custody on 29.5.2025. 4. Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondent-State. Perused the record. 5. Learrled Assistant Public Prosecutor submits that the injury sustained by the defacto complainant is grievous in nature and major part of investigation is completed and prays to dismiss the criminal Petition. 6. Learned counseI' for the p`etitioners submits that it is a case and counter and the accused persons sustained injuries in the hands of the defacto complainant and others and there a're some long pending disputes between the accused and the defacto complainant and prays to allow the Criminal Petition. 7. On perusal of the material available on record goes to show that there were disputes between both the defacto complainant and the accused, and in connection with that, case and counter cases have been registered as against each other. The petitioners filed a report against the defacto complainant, and basimg on the same, a case Crime No.94/2025 of Chapadu pol-lee station was registered. In the said counter HIE=-* 4 case i.e. crime No.94/2-025 of Chapadu Police Station, the accused were arrested and released on bail. ln the present case on hand, the PetitI-OnerS Were arrested On 27.5.2025, since then they are langul'shing in J-ail. In view of the aforesaid facts and circumstances of the case, this Court is inclI'ned tO grant bail to the p6titl'oners herein, on the following conditions. (I') The petitioners/A1, A3 to A7 herein shall be released on their executing a personal bond for Rs.10,000/-(Rupees ten thousand only) each, with two sureties for a like sum each to the satisfaction of the learned Judicial Magistrate of First Class, Mydukuru, Kadapa District,' (ii) On release, the petitioners shall appear before the station House Officer concerned once in a week i.e. on every sunday between 10.00 a.m. and 05.00 p.m., till filing of charge sheet.
