Petitioner has earlier approached this Court by way of filing Writ Petition No.57439 of 2016, which was disposed of by an order dated 06.12.2016, to consider the case of petitioner for payment of promotional pay scale. It was not disclosed that petitioner was already retired on 31.03.2016. 3. In the aforesaid circumstances, District Basic Education Officer, Mau has considered the case of petitioner, however, it was rejected by order dated 28.01.2017, on a ground that petitioner was under suspension by an order dated 21.10.2013, as recorded in service book, therefore, his services were not satisfactory. The relevant part of order is reproduced hereinafter :- " सममीकक यकचमी, ससंस्थक प्रबन्धक दकरक प्रस्ततुत अभभिललेखखों एवसं ककयकर्यालय मम उपलब्ध अभभिललेखखों कले परमीकण करनले कले उपरकन्त यह तथ्य प्रककश मम आयक भक शमी गकसंधमी महकदलेव भवदकलय बसंगकलमी भपजडक मऊ स्थकयमी मकन्यतक प्रकप्त एवसं रकज्य सरककर दकरक अनतुदकभनत भवदकलय हहै। भवदकलय मम यकचमी सभहत कतु ल 07 अध्यकपक भनयतुक्त थले प्रप्रोन्ननत वलेतन मकन कले सम्बन्ध मम भनगर्यात शकसनकदलेश ससं० 4307/15.8. 3038/99 भदनकसंक 20.12.2001 मम भनभहत प्रकभवधकनखों कले अनतुसकर चयन वलेतनमकन मम 12 वरर्या ककी ससंतप्रोरजनक सलेवक पपूणर्या करनले कले उपरकन्त प्रप्रोन्नत वलेतनमकन चयन वलेतनमकन कले पदधकरकखों ककी ससंख्यक कप्रो 20 प्रभतशत ककी रकभश तक दलेय हप्रोगक। ससंस्थक प्रबन्धक दकरक उपलब्ध करकयले गयले भशककखों कले भनयतुभक्त अनतुमप्रोदन एवसं सलेवकभनववृत ककी सपूचमी कक परमीकण करनले पर यह पकयक गयक भक शमी रमककर भदवलेदमी स०अ० कले भदनकसंक 30.06.2014 कप्रो सलेवकभनववृत हप्रोनले कले उपरकन्त भदनकसंक 01.07.2014 सले यकचमी शमी बवृजनकथ स०अ० कप्रो प्रप्रोन्नभत वलेतनमकन दलेय हहै। जबभक ससंस्थक प्रबसंधक दकरक यकचमी शमी बवृजनकथ स०अ० कप्रो भवदकलय कले भशकण व्यवस्थक मम असहयप्रोग एवसं ससंतप्रोरजनक सलेवक न करनले कले ककरण भदनकसंक 21.10.2013 कप्रो भनलसंभबत कर उक्त ककी प्रववृभष्टि यकचमी ककी सलेवक पतुसस्तकक मम ककी गयमी हहै। भनणर्याय सतुनवकयमी मम सम्बसन्धत पकप्रो दकरक प्रस्ततुत अभभिललेखखों एवसं शकसनकदलेश भदनकसंक 20.12.2001 कले क्रम मम ससंस्थक प्रबसंधक दकरक यकचमी शमी बवृजनकथ स०अ० कप्रो भवदकलय कले भशकण व्यवस्थक मम असहयप्रोग एवसं ससंतप्रोरजनक सलेवक न करनले कले ककरण भदनकसंक 21.10.2013 कप्रो भनलसम्बत कर उक्त ककी प्रववृभष्टि यकचमी ककी सलेवक पतुसस्तकक मम ककी गयमी हहै। अततः यकचमी ककी सलेवकए ससंतप्रोरजनक न हप्रोनले कले ककरण भनयमकनतुसकर प्रप्रोन्नभत वलेतनमकन दलेय नहहीं हहै। अस्ततु मक० उच्च न्यकयकलय कले पकररत आदलेश भदनकसंक 06.12.2016 कले अनतुपकलन मम यकचमी कक प्रकरण एतददकरक भनस्तकररत भकयक जकतक हहै।" 4. Learned counsel for petitioner has referred an order dated 07.07.2014, whereby Committee of Management of concerned school has revoked suspension, though it is not on record i.e. it was communicated to concerned B.S.A. and whether it was approved or not, therefore, it may be a reason that this order was not recorded in service book of petitioner and impugned order was passed only on basis of entry of suspension order in service book. 5. In the aforesaid circumstances, as referred above, a case of interference is made out as the aforesaid order was not considered or placed before the concerned respondent. Accordingly, impugned order dated 28.01.2017 is set aside and matter is remitted to concerned respondent to pass fresh order after taking note of above referred order dated 07.07.2014. Since petitioner is presently aged about 72 years, therefore, the decision be taken within 6 weeks, by concerned respondent. 6. Accordingly, writ petition is disposed of with aforesaid observation.
