Heard the learned counsel for the parties. 3. FIR in Crime No.49/2025 was registered by Sakaleshpura Rural Police Station, Hassan for the aforesaid offences against the petitioner on the basis of the first information dated 24.02.2025 received from his wife Vilasini. 4. During the course of investigation of the case, petitioners were arrested on 25.02.2025 and subsequently, remanded to judicial custody. Bail application filed by the petitioner in Crl.Mis.No.234/2025 before the Jurisdictional Sessions Court was rejected on 12.03.2025. Therefore, the petitioner is before this Court. 5. Perusal of the material on record would go to show that the marriage of the petitioner with the first informant - - 3 - NC: 2025:KHC:16502 CRL.P No. 4510 of 2025 Vilasini was performed about 17 years prior from date of registration of FIR and from the wedlock, they have two children. In the first information it is alleged that petitioner was suspecting the fidelity of his wife and therefore, he was regularly quarreling with her. On 24.02.2025 at about 12.30 pm, he had quarreled with his wife on the same ground and thereafter, with a intention to commit her murder, he allegedly had tried to strangulate her neck with a rope and as a result, she lost her consciousness and subsequently, she was shifted to a hospital where she was treated. Undisputedly, the first informant who is the wife of the petitioner has suffered only simple injuries in the alleged incident in question. Allegation as against the petitioner who is the husband of the first informant is that he had tried to commit her murder by strangulating her neck with the rope. Petitioner having no criminal antecedents is in custody from 25.02.2025. Major portion of the investigation is completed. Petitioner has got two minor children who are required to be taken care of. Under such circumstances, I am of the opinion that the prayer made by the petitioner for grant of regular bail is required to be answered affirmatively. Accordingly, the following:- - 4 - NC: 2025:KHC:16502 CRL.P No. 4510 of 2025 ORDER The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.49/2025 registered by Sakaleshpura Rural Police Station, Hassan, for offences punishable under Sections 352, 238 and 109(1) of the Bharatiya Nyaya Sanhita, 2023 (for short, 'BNS'), subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; - 5 - NC: 2025:KHC:16502 CRL.P No. 4510 of 2025 e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
