3 The Court made the following Order: This Writ Petition is filed under Article 226 of the Constitution of the India seeking the following reliefs:-
“to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the inaction on the part of the Respondent No 2 and 5 in acting upon the report submitted by the Respondent No 4 dated 18 03 2025 by changing the total extent of land to Ac 0 45 cents from Ac 0 30 cents in L P No 69 Sy No I38/4A of Haripalem Village Atchutapuram Mandal Anakapalli District as illegal arbitrary abdication of Statutory duty cast on the Respondents apart from being violation of the Fundamental and Constitutional Rights guaranteed me under Article 14 19 21 and 3 OOA of the Constitution of India and consequently direct the Respondent No 2 to 5 to rectify the records and update the total land in an extent of Ac 0 45 cts Instead of Ac 0 30 revenue 14 Cts in L P No 69 Sy No I38/4A of Haripalem Village Atchutapuram Mandal Anakapalli District in my favour by acting upon report dated 18 03 2025 submitted by the Respondent No. 4 and pass such other order. ” Heard
learned counsel for the petitioner and learned Assistant Government Pleader for Revenue appearing for the respondents.
Learned counsel for the petitioner would submit that even though respondent No.4 after having due enquiry submitted a report dated 18.03.2024 directing respondent No.5 to update the revenue record with respect to subject land, but for reason or the other, respondent Nos.5 & 6 are not carrying or

4 updating the record with respect to the subject land. Hence, the present Writ Petition. 4. On the other hand, learned Assistant Government Pleader for Revenue submit that in view of the enquiry and report dated 18.03.2025 submitted by respondent No.4, the respondent Nos.5 & 6 being subordinate and competent authority to respondent No.4, they shall adhere and execute the orders of respondent No.4, within a reasonable time in accordance with the law. Considering the submissions of learned counsel for the o. petitioner, learned Assistant Government Pleader and on perusal of the material available on record, this Court is of the opinion that it is appropriate to dispose of the Writ Petition directing respondent Nos.5 & 6 to update the revenue record in respect of the land in Ac.0.45 Cents from Ac.30 72 Cents in L.P.No.69 (Sy.No.138/4A) of Haripalem Village, Atchutapuram Mandal, Anakapalli District, with reference to the report and directions submitted by respondent No.4 on 18.03.2025 and ass per his entitlement under the provisions of the AP Rights in Land Pattadar Passbook Act, 1971 by observing principles of natural justice and by providing an opportunity of hearing to the
5 petitioner and other stake holders if any, within a period of two (02) months from the date of receipt of copy of this Order. 6. Accordingly, the Writ Petition is disposed of.
