Cr.MP(M) No.1811 of 2025 This application has been filed for condonation of delay in filing the application for grant of leave to appeal against the judgment dated 03.09.2024, passed by learned Additional Sessions Judge (1), Solan, District Solan, H.P. in case Registration No.49/2016, under Sections 302, 367, 120-B of IPC, registered in case FIR No.24, dated 09.03.2016 at Police Station Parwanoo, District Solan,H.P. against the respondents, namely, Bir Chand, Raj Kumar, Shiv Kumar and Rakesh Kumar @ Pawan. Learned counsel for the appearing respondents, on previous date, had informed this Court that one appeal bearing Cr. Appeal No.387 of 2025 already stands filed by the State of H.P. against the impugned judgment passed in the same case and same FIR, therefore, matter was adjourned for today for listing this application along with the aforesaid appeal. Perusal of the record indicates that both appeals have been preferred in one and the same case. Learned Additional Advocate General Submits that because of miscommunication, two appeals have been preferred in one and the same case, therefore, she seeks permission to withdraw this application along with proposed application filed for the grant of leave to appeal as well as criminal appeal. Accepting the prayer made by learned Additional Advocate General, this application is dismissed as withdrawn. Consequently, in view of the above, the proposed application for the grant of leave to appeal bearing CRMPMST No.6994 of 2025 as well as proposed Cr. Appeal No. 6936 of 2025 also stand disposed of. Cr. Appeal No.387 of 2025 Bail bonds on behalf of respondents No.1,3 & 4, stand furnished. Bail bonds on behalf of respondent No.2, in terms of order dated 09.07.2025, be furnished on or before 30.10.2025. Bail bonds so furnished shall be transmitted by the Trial Court to the Registry of this Court for placing on record.
