Heard the learned Counsel for the parties. 3. FIR in Crime No.133/2024 was registered by Nagamangala Police Station, Mandya District, for the aforesaid offences against the petitioner and others based on the first information dated 26.11.2024 received from Prashanth Kumar.D.V. - brother of deceased Sanjushri. Apprehending arrest in the said case, petitioner had filed Crl. Misc. No.35/2025 before the jurisdictional Sessions Court, which was rejected on 07.02.2025. Therefore, he is before this Court. 4. deceased was not properly taken care of in her matrimonial house and her in-laws were teasing and ill-treating her on petty issues.
It appears that subsequently deceased had left her matrimonial house and had taken shelter in the house of the first informant. On 25.11.2024, deceased had committed suicide by hanging herself in the house of the first informant. 5. There is no mention in the first information of any such incident which had taken place immediately prior to the death of the deceased which would have abetted her or instigated her to commit suicide. The other accused persons are said to have been already granted anticipatory bail in the present case. Petitioner has undertaken to cooperate with the police for the purpose of investigation. Petitioner has no other criminal antecedents. Considering the aforesaid aspects of the matter, I am of the opinion that petitioner's prayer for grant of anticipatory bail requires to be answered affirmatively. Accordingly, the following order:
6. The petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.133/2024
