CMP (M) No. 2229 of 2025 As per the report of the Registry respondents stand duly served. The present application has been filed for condonation of delay in filing appeal. In para No. 3 of the application the reason has been assigned for the said delay, which is plausible. In view of the submissions made by learned counsel for the parties, and since the averments in the application are duly supported by an affidavit, the present application is allowed and delay of 266 days in filing RSA is condoned. Application is allowed and disposed off. RSA No.____/2026 (Filing No. RSA/65105/2025) Appeal be registered. Heard. Admitted on the following substantial questions of law:-
1. Whether the Appellate Court can direct the State to initiate the land acquisition proceedings after a period of 25 years from the date of construction of road when their predecessor in
their lifetimes never claimed or raised objection qua compensation.
2. Whether the judgments and decrees of both the learned Court below are based on mis- appreciation and misinterpretation of the evidence and legal provision.
Post admission notices be issued to the respondents returnable within four weeks, on taking steps within one week.
