The present writ petition is filed assailing non-payment of admitted final bill amount in respect of work executed by the petitioner issued by the Director, Char Areas Development Assam, Hengrabari Road, Dispur, Guwahati-06 by its letter No. CADA-298/2019-20/979-87 dated 15 October 2019 for supply of Bio Organic Soil Enricher (Variety-Soil Enricher-Bio Power) for distribution amongst small and marginal farmers of different Char Areas of Assam for the year 2019- 20. According to the petitioner, the petitioner has duly delivered the aforesaid ordered materials and final bill amounting to Rs. 1,15,96,095/- is still pending due. 2. The learned counsel for the petitioner submits that in view of the dispute raised in the affidavit-in-opposition filed by the respondent No. 2, she may be allowed to withdraw the present writ petition and to approach the appropriate civil court seeking appropriate remedy including damages and compensation. 3. Prayer is not opposed by Ms. MD Bora, learned counsel for the respondent No. 2, Ms. G Bora, learned counsel for the respondent No. 1 and Ms. RM Baruah, learned standing counsel for the Finance Department. Accordingly, same stands allowed. 4. The present writ petition stands closed with a liberty to the petitioner to Page No.# 3/3 approach competent forum for redressal of grievances including compensation and damages.
