Heard the learned counsel for the petitioner and the learned counsel for the respondent. 2. The petitioner, who has been charge-sheeted for offences punishable under Sections 120B read with 420, 409, 477-A of IPC, and Section 13(2) read with 13(1)(d) of the Prevention of Corruption Act, 1988, is before this Court seeking relief. 3. The petitioner filed an application seeking permission to travel to the United States of America along with his wife to assist their daughter during maternity. The Trial Court granted permission for a period of two months. However, the petitioner is seeking permission to travel for a period of six months, but the Trial Court has restricted the duration to two months. 4. The learned counsel for the respondent-CBI submitted that the period granted by the Trial Court is reasonable and that the petitioner has not made out a - 3 - NC: 2025:KHC:12160 CRL.P No. 4034 of 2025 prima facie case for extending the travel period to six months. 5. Admittedly, further proceedings concerning the alleged offences against the petitioner have been stayed by this Court in Crl.P. No. 1676/2025, which remains in effect as of today. The petitioner intends to travel to the United States along with his wife to assist their daughter during her maternity period. Considering the circumstances, the petitioner is entitled to travel abroad for a period of six months. Therefore, the impugned order passed by the Trial Court requires modification. ORDER i) The petition is allowed; ii) The impugned order dated 18.3.2025 passed by the learned XLVII Additional City Civil and Sessions Judge and Principal Special Judge for CBI Cases, Bengaluru (CCH-48) in Spl.C.C. No.1629/2023 is modified. iii) The Petitioner is permitted to Travel to the United States of America for a period of 6 months from 27.3.2025 to 26.9.2025. iv) The conditions imposed by the learned Sessions Judge shall remain unaltered. - 4 - NC: 2025:KHC:12160 CRL.P No. 4034 of 2025 v) The petitioner to furnish Itinerary in the form of affidavit with the respondent-CBI on or before 27.3.2025.
