B E F O R E HON’BLE MRS. JUSTICE GOLMEI GAIPHULSHILLU 07.03.2025 Heard Mr. W. Darakishwar, learned Sr. PCCG appearing for the petitioner. Mr. W. Darakishwar, learned Sr. PCCG pointed out that vide order dated 7.9.2022 (Annexure-A/6) due to none appearance of the accused/petitioner, the learned Trial Court issued warrant of arrest (Annexure-A/7). Vide order dated 7.6.2022, Ld. Trial Court allowed the accused/petitioner to go on interim bail (Annexure-A/5) on medical ground and directed to appear before the Court on 7.9.2022. Inspite of Courts’ direction, the accused/petitioner was absent (Annexure-A/6) because of that the surety of the accused was discharged and directed the I.O to look out for the petitioner/accused and to arrest and thereafter warrant of arrest was issued by the Ld. Trial Court against the accused/petitioner on 7.9.2022. Learned Sr. PCCG for the petitioner submits that after this proceeding of Ld. Trial Court, accused/petitioner was declared as offender
and since the accused is declared as pro-offender, the Zima order dated 2.8.2022 (Annexure-A/1) may be set aside. After hearing the learned Sr. PCCG for the petitioner and also going through the records, I am satisfied with the submission and prayer made by learned Sr. counsel for the petitioner. Accordingly, the Zima order dated 2.8.2022 is set aside. Hence, the present Crl. Rev. P. No. 26 of 2022 is disposed of.
