JUSTICE HASMUKH D. SUTHAR Date : 13/06/2025 ORAL ORDER RULE. Learned APP waives service of notice of Rule for and on behalf of the respondent – State of Gujarat. [1.0] By way of present petition, the petitioner prays for direction directing the police authority to release the petitioner to the satisfaction of ld. Additional Sessions Court, Himmatnagar, Dist. Sabarkantha and seeks remission. [2.0] When the matter is called out, learned counsel for the petitioner has remained absent. However, with an assistance of learned APP, matter is taken up for its final disposal. [3.0] Perusing the record, it appears that the petition is not happily worded and there is no any material which suggests that the petitioner has approached any authority by way of application or representation. [4.0] In view of the above, no case is made out to pass any order under Article 226 of the Constitution of India. However, it is open for the petitioner to approach the authority by preferring application or R/SCR.A/3055/2025 ORDER DATED: 13/06/2025 representation and if any such representation is filed, the same shall be decided by the authority concerned in accordance with law.
