JUSTICE PARTHIVJYOTI SAIKIA ORDER Date : 27.02.2025 This is a common order for these two bail applications. 2. Heard Mr. F.Z. Mazumder, the learned counsel appearing for the petitioners. Also heard Mr. KK Das, the learned Addln. Public Prosecutor for the State of Assam. 3. These applications are filed u/s 482 of the BNSS, 2023 for grant of pre-arrest bail in respect of Nilam Bazar PS Case No. 203/2024. 4. Mr. Mazumder has submitted that pursuant to the interim order dated 13.12.2024, the petitioner Setab Uddin has appeared before the Investigating Officer and his statement has been recorded. 5. Mr. KK Das submits that the CD which he received is not up-to-date. Therefore, he prays for some more time to produce the updated case diary. 6. The prayer of Mr. Das is allowed. 7. I have considered the submissions made by the learned counsel of both sides. 8. Since the petitioner Setab Uddin is co-operating with the Investigating Officer, he does not deserve to be detained in custody. 9. The interim bail granted on 13.12.2024 in favour of the petitioner Setab Uddin is hereby made absolute. Therefore, the Anticipatory Bail Application No. 3272/2024 filed by Setab Uddin is allowed and disposed of. List on 18.03.2025 for production of the up-to-date case diary. JUDGE Comparing Assistant
