Chamuah, learned counsel along with Mr. P. K. Bhuyan, learned counsel appearing on behalf of the petitioners. Also heard Mr. J. Handique, learned counsel appearing for the respondent no. 1 and Mr. N. Goswami, learned counsel appearing for the respondent nos. 2 & 3. None has appeared for the respondent no. 4. 2. The petitioners, in the present writ petition have contended that the Government in collaboration with the respondent no. 4, had decided to establish an Industrial Area, namely, Information Technology Park (IT Park), Guwahati, and for the purpose, the competent authority had issued a notification under Section 4(1), Section 17(4) along with a declaration under Section 6 of the Land Acquisition Act, 1894, for the acquisition of 23 Bighas 3 Kathas 15 Lechas, situated in village Bongara under Chayani Mouza, Palasbari Revenue Circle in the district of Kamrup. It is projected in the writ petition that the land so proposed to be acquired also include the land possessed by the petitioners herein. 3. The said acquisition proceeding was so carried out after registration of Land Acquisition Case No. 02/2013. It is revealed from the records that the award on being computed by the Deputy Commissioner, Kamrup was forwarded to the Government in the Revenue Department for approval and the said award was so approved by the competent authority on 09.01.2014. 4. The learned counsel for the petitioners submits that the award in question in L.A. Case No. 02/2013 having been so approved only on 09.01.2014 i.e., after coming into force of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Re-Settlement Act, 2013 (hereinafter referred as the Page No.# 8/9 Act of 2013) w.e.f., 01.01.2014, the computation of compensation ought to have been so made in terms of the provisions of the Act of 2013. 5. In this connection, the learned counsel for the petitioner has relied upon a decision of the Division Bench of this Court in the case of State of Assam Vs On the death of Ananta Ram Nath and his legal heirs, disposed of vide Judgment & Order dated 24.03.2025 (Writ Appeal No. 185/2017), wherein, under similar circumstances, the Division Bench had held that the award therein, having been approved by the competent authority only on 09.01.2014, following the decisions of the Hon’ble Supreme Court in the case of Bailamma (Smt.) Alias Doddabailamma (Dead) & Ors. Vs. Poornaprajna House Building Cooperative Society & Ors., reported in (2006) 2 SCC 416, the respondents therein would be entitled to the compensation in terms of the provisions of the Act of 2013. Accordingly, Mr. Chamuah, learned counsel for the petitioners submits that the respondent authorities be directed to compute the compensation in L.A. Case No. 02/2013 in respect of the land acquired belonging to the petitioners herein, in terms of the provisions of the Act of 2013. 6. The learned counsels appearing for the respondents have not disputed the contention raised by the learned counsel for the petitioners and have fairly submitted that the present case is also covered by the decisions of the Hon’ble Court in the case of On the death of Ananta Ram Nath and his legal heirs (supra). 7. In view of the above position, the respondent authorities are directed to determine the compensation receivable by the petitioners for the land acquired by them and involved in L.A. Case No. 02/2013 by applying the provisions of the Act of 2013 and release to the petitioners their due compensation expeditiously by adjusting any compensation already paid to them. 8. The above exercise shall be initiated and completed by the respondent Page No.# 9/9 authorities within a period of 3(three) months from the date of receipt of a certified copy of this order. 9. With the above observations and directions, the present writ petition stands disposed of. JUDGE Comparing Assistant
