HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 7159/2024 Sonu Lavvanshi S/o Premchand, Aged About 23 Years, R/o Saikud Police Station Sarthal Dist. Baran (Raj.). ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Kuldeep Bhatia For Respondent(s) : Ms. Manju Dave, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 10/01/2025 1. Apprehending his arrest in connection with FIR No.77/2024 registered at Police Station Harnawada-Shahji, District Baran for the offence(s) under Sections 8/21 read with Sections 25 and 29 of NDPS Act, the petitioner has preferred this anticipatory bail application under Section 438 Cr.P.C. 2. Learned counsel for the petitioner submits that the petitioner has falsely been implicated solely on the basis of information furnished by other co-accused from whom 20 grams of smack was recovered. Apart from the information furnished by the other co- accused, there is no reliable direct or indirect evidence available on record against the petitioner. It is also contended that there are no criminal antecedents against the petitioner and the petitioner is ready and willing to co-operate with the investigation, therefore, anticipatory bail of the petitioner may be allowed. 3. Learned Public Prosecutor vehemently opposes the anticipatory bail application. (2 of 2) [CRLMB-7159/2024] 4. Heard and perused the material available on record. 5. Considering the fact that the recovery of contraband articles containing 20 grams of smack was effected from other co-accused Mukesh and Lokesh and on their information, the petitioner has been involved. There is no credible evidence available on record that petitioner was involved in supplying the said contraband articles, therefore, considering the above facts, without commenting anything on the merits of the case, I deem it just and proper to allow the anticipatory bail application of the petitioner. 6. Accordingly, the anticipatory bail application under Section 438 Cr.P.C. is allowed and it is ordered that in the event of arrest of the petitioner Sonu Lavvanshi S/o Premchand, in connection with FIR No.77/2024 registered at Police Station Harnawada- Shahji, District Baran, he shall be released on bail, provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station on the following conditions:- (i) that the petitioner shall make himsel available for interrogation by a police officer as and when required; (ii) that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the court or any police officer, and (iii) that the petitioner shall not leave India without previous permission of the court.
