Sandhawalia, Chief Justice (Oral) CMP(M) No. 2404 of 2025 Keeping in view the averments made in the application, duly supported by an affidavit of the official, the delay of 505 days in filing the appeal against the judgment dated 21.05.2024 passed by the learned Single Judge is condoned. The application stands disposed of accordingly. LPA No. 224 of 2026 In view of the fact that in LPA No. 109 of 2024, titled State of H.P. and another vs. Roshan Lal Khajuria and another, decided on 22.05.2025, the order passed by the learned Single 1Whether the reporters of the local papers may be allowed to see the Judgment? Yes -2- Judge has been set aside and the matter is being heard alongwith Civil Writ Petition No. 2108 of 2023, which is still pending. The learned Single Judge, while allowing the writ petitions by the order under challenge, had placed reliance upon various orders, including the order passed in Civil Writ Petition No. 5651 of 2023 titled Dr. Sunil Kumar Chandel and others vs. State of H.P. and others, decided on 26.09.2023. 2. In LPA No.109 of 2024 titled as Roshan Lal Khajuria and another vs. State of H.P. and another, it has been noticed that LPA No. 85 of 2024 was allowed by the Coordinate Bench and the judgment was set aside, and the case of Dr. Sunil Kumar Chandel was restored. In such circumstances, we deem it appropriate that Civil Writ Petition No. 4586 of 2023 be restored to its original position and be heard along with Civil Writ Petition No. 2108 of 2023 titled Bhagat Ram vs. HRTC and others along with connected matters, which was the lead case and had initially been allowed, but the order was subsequently recalled/reviewed on 30th August, 2024. 3. In view of the above, the appeal stands allowed. Civil Writ Petition No. 4586 of 2023 is restored to its original position and shall be heard along with Civil Writ Petition No. 2108 of 2023 titled Bhagat Ram vs. HRTC and others along with connected matters. -3- In view thereof, the appeal stands disposed of, as also the pending miscellaneous applications, if any.
