Despite grant of several opportunities, the non- applicant/respondent has not filed reply. Learned counsel for the non-applicant/respondent states that delay in instituting the appeal be condoned as the respondent does not intend to oppose the application.
2. I have heard learned counsel for the parties and considered the application, which is duly supported by an affidavit. The applicant/appellant has cogently explained the delay in institution of the appeal. The application is not even opposed by the non-applicant/respondent.
3. Accordingly, for the reasons stated in the application and the submissions made by learned counsel for the parties, delay in filing the appeal is condoned.

6. Parties are, however, at liberty to seek modification/alteration of the order.
