PUBLIC PROSECUTOR The Court made the following Order: The learned counsel for the petitioner/accused submits that the petitioner, while working as Tahsildar, has wrongly recommended for the grant of compensation to one Shaik Bhimabi. The learned counsel submits that the petitioner has only submitted the genuineness certificate based on the mutation of the name of one Shaik Bhimabi, in the revenue records whose name was mutated by the then MRO, Kaluvoy Mandal. As such, the petitioner cannot be made responsible for disbursement of compensation or the issuance of the genuineness certificate. It is submitted that the petitioner had recommended the names of as many as 13 land losers and the genuineness certificate is 2 based purely on the revenue records maintained at the office of MRO, Kaluvoy Mandal. 2. It is submitted that the petitioner was transferred from Kaluvoy on 18.03.2021 and the proceedings issuing the genuineness certificate were prepared on 10.03.2021. The RDO filed a complaint before the Police Station, Kaluvoy, on 23.01.2023 and Crime No.8 of 2023 was registered against the petitioner for the alleged offences under Sections 120-B, 409, 420, 417, 465 and 471 read with 34 of the Indian Penal Code (I.P.C). 3. It is submitted by the learned counsel for the petitioner/accused that the petitioner is now discharging his duty as Tahsildar, Atmakur. 4. The learned Assistant Public Prosecutor submits that investigation is still pending and that certain documents are awaited from the office of Tahsildar, Kaluvoy. 5. Considering the submissions of the learned counsel for the petitioner/accused that the petitioner is still discharging his duties as Tahsildar, Atmakur and that no departmental enquiry or action has been initiated against the petitioner, this Court deems it appropriate to direct the Station House Officer, Kaluvoy Police Station, Nellore District, to expedite the investigation and file the final report. The 3 petitioner shall cooperate with the investigation and appear before the police station as and when required. 6. With these observations the criminal petition is disposed off.
