Heard Ms. D. Devi, learned counsel for the applicant/respondent No. 1/claimant and Ms. S. Saikia, learned counsel for the appellant/opposite party No. 1 i.e. the Insurance Company.
2. Through this application, the applicant/respondent No. 1/claimant has prayed for withdrawal of 25% of the awarded amount i.e. Rs.16,10,629/- (Rupees Sixteen Lacs Ten Thousand Six Hundred and Twenty Nine). The learned Member, Motor Accident Claims Tribunal, Sonitpur, Tezpur has directed the Insurance Company to pay the awarded amount of Rs.55,66,780/- (Rupees Fifty Five Lacs Sixty Six Thousand Seven Hundred and Eighty) in favour of the applicant/claimant.
3. Learned counsel appearing for the Insurance Company has no objection if the claimant withdraws 25% of the awarded amount i.e. Rs.16,10,629/- (Rupees Sixteen Lacs Ten Thousand Six Hundred and Twenty Nine)
4. I have considered the submissions. The applicant/claimant is allowed to withdraw 25% of the awarded amount deposited before the Registry of this Court after proper verification of the claimant by the Registry.
5. In terms of the above observation, this Interlocutory Application stands
