THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 18773 of 2021 ORDER:
This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“…pleased to issue a Writ, order or direction more particularly one in the nature of Writ of Mandamus, declaring the action of the 3rd respondent in interfering with the civil dispute between the Petitioner and the respondents 4 and 5 and threatening the Petitioner to vacate the premises bearing D.No. 39-26-79/2, situated at NH-16 Road, Rajeev Nagar, Punjab Hotel Junction, Visakhapatnam-530007 within the limits of Greater Visakhapatnam Municipal Corporation and to hand over the same to the respondents 4 and 5 by calling the Police Station frequently and detaining the Petitioner hours together is as illegal, arbitrary, unjust and contrary to the Fundamental Rights guaranteed to the Petitioner under the Constitution of India and consequently direct the 3rd respondent not to interfere with the civil dispute between the Petitioner and the respondents 4 and 5, and pass.…”
2. When the matter was taken up for hearing, learned counsel for the petitioner would submit that the petition may be disposed of, since the relief has become infructuous in this matter. 3.
Learned Assistant Government Pleader for Home for the respondents is in attendance. 4. Recording the above said submission, the Writ Petition is dismissed as infructuous. There shall be no order as to costs. 4
