Tulsyan, Advocate Digitally signed by AJINKYA PANSARE Date: 2025.04.03 17:22:09 +0530 2 Hon’ble Shri Justice Rakesh Mohan Pandey Judgment On Board 03-04-2025 1) By way of this petition, petitioner has challenged the order passed by the Tahsildar, Teh.- Makdi, Dist.- Kondagaon in Case No. 9/A-6/2018- 19 dated 19.06.2019 whereby the name of the petitioners has been deleted from the revenue records pertaining to the Khasra Nos. 1/4 , 1/5 , 2, ; Khasra Nos. 10/2, 11/2, 13/1 and Khasra No. 12/4, total ad- measuring 6.66 acres situated over Village Amrawati, P.H. No. 46, Kondagaon. 2) Evidently, the order passed by the Tehsildar, Teh. Makdi is appealable according to the provisions of Section 44 of the Chhattisgarh Land Revenue Code, 1959. 3) At this stage, learned counsel for the petitioners submits that this petition may kindly be disposed reserving liberty in favor of the petitioners to prefer an appeal before the Sub-Divisional Officer (Revenue) Kondagaon and the authority concerned may be directed to decide the same expeditiously. 4) No objection from other side. 5) Taking into consideration the submission made hereinabove, present writ petition is hereby being disposed of reserving liberty in favor of petitioners to prefer appeal along with application for grant of stay within period of 30 days from today before the Sub-Divisional Officer (Revenue) Kondagaon. It is expected that the authority concerned will decide the application for grant of stay in objective manner, preferably within period of 30 days from the date of receipt of copy of the application. For a period of 60 days, the interim order issued by this 3 Court dated 04.09.2020 shall remain operative. 6) With the aforesaid direction(s), instant writ petition stands disposed of.
