The present writ petition is instituted in public interest seeking following relief:
“ to issue a writ, order or direction, more particularly, one in the nature of WRIT OF MANDAMUS declaring the action of respondents 2 to 5 in not preventing respondents 6 and 7 in forming the unauthorized layout in a government land/kunta land by encroaching canal Panta Kaluva in Survey No 1926 of Addanki North Revenue Village in Addanki Mandal of Bapatia District, as illegal, irregular and offends Articles 14 and 21 of Constitution of India, and contrary to the provisions of Andhra Pradesh Land

WP (PIL) No.114 of 2025 Encroachment Act, 1905 and Andhra Pradesh Municipalities Act, 1965 and Rules framed thereunder and consequently direct the respondents 2 to 4 to protect the kunta land/Government land in Survey No 1926 of Addanki North Revenue Village in Addanki Mandal of Bapatia District and remove the encroachments from the aforesaid land and to pass…”
2. The petitioner claims that land admeasuring Ac.6.36 cents in Survey No.1926 of Addanki North village has been classified as
“Kunta poromboke land” in revenue records. The unofficial respondents have encroached upon said land and are trying to form a layout and alienate the same. Petitioner, therefore, stated to have submitted representation, dated 21.04.2025, to the 2nd respondent to take appropriate action for evicting the encroachers and also to ensure that the land is not used for layout. As there was no response, petitioner chose to file present writ petition. 3. Learned Government Pleader for Revenue appearing for respondents 1 to 4 has placed on record written instructions vide Rc.No.DT/787/2025, dated 07.07.2026, which inter alia state that the subject land has been classified as “Government poramboke” and used as “pond”. Further, as per FMB, the said survey number has been divided as S.No.1926/1 to an extent of Ac.0.11 cents classified as “Canal”; and S.No.1926/2 to an extent of Ac.6.22 cents classified as “pond”.
Further, that as per webland adangal, S.No.1926/1 to an

WP (PIL) No.114 of 2025 extent of Ac.0.11 cents only was noted as “Government Land - Canal” and the other survey number is left out, therefore, now necessary steps are being taken to correct the same and also requisition, dated 06.07.2026, has been made to the District Collector, Prakasam, to place aforesaid two parcels of lands in prohibited list to avoid any further registrations over the said Government land, which is pending
consideration. The letter so addressed by the 4th respondent to the 2nd respondent is also annexed.
4. We have taken note of the contents of the instructions referred to above. We expect the 2nd respondent District Collector, Prakasam, to act upon the requisition of 4th respondent to place the subject property under prohibited list, ensuring the same is not susceptible to any further registration in the hands of private parties. We also direct the respondents to ensure that the subject property is protected and safeguarded and be put to the use of canal/pond as per its classification. The aforesaid exercise is directed to be completed as expeditiously as possible, preferably, not later than two weeks from the date of receipt of a copy of this order.
5. Accordingly, the writ petition stands disposed of. No order as to costs.
