W.P(MD)No.22878 of 2019 BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT DATED: 17.11.2025 CORAM THE HONOURABLE MS.JUSTICE P.T.ASHA Writ Petition(MD)No.22878 of 2019 T.Balachander .. Petitioner Vs The Registrar, Annamalai University, Annamalai Nagar, Chidambaram, Tamil Nadu 608 002. .. Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the respondent herein to confer the first class M.E., Power System Degree instead of II Class M.E Power System Degree to the petitioner. For Petitioner : Mr.T.Rajaraman For Respondents : Mr.C.Venkatesh Kumar for M/s.Ajmal Associates ORDER The present writ petition has been filed seeking for issuance of mandamus directing the respondent to confer the 1st Class M.E.Power System Degree instead of II Class M.E.Power System Degree to the petitioner. 1/4 https://www.mhc.tn.gov.in/judis W.P(MD)No.22878 of 2019 2.The petitioner would submit that he joined M.E.Power System Course in the respondent University in the month of October-1990. The first semester examination was held in the month of May 1991. Due to health reason, the petitioner could not write the examination in the first semester. Thereafter, the petitioner requested the respondent to allow him to write the arrears in the month of December 1991, however, the respondent refused to allow the petitioner to write the arrears. The petitioner had written the first semester papers in the month of May 1992, which is the next academic year. It is the grievance of the petitioner that though he has secured 64% in the examination, he was given only II Class degree. It is his contention that he has to be granted 1st Class, since had has obtained over 60%. 3.Regulation No.6(b) and 6(c) of the respondent University, reads as follows: “6..... b)A candidate shall be declared to have passed in First CLASS if he/she obtain a minium of 60 percent of the total aggregate for all the semesters and thesis in the first attempt. ..... c)All other condidate shall be declared to have passed in Second Class if he/she secures 50 percent and above of the total aggregate of marks for all the semesters. 2/4 https://www.mhc.tn.gov.in/judis W.P(MD)No.22878 of 2019 4.Reading of Clauses 6(b) and 6 (c) of the University clearly shows that there is no error in the impugned order, as the respondent would fall within a Regulation Clause 6(c) and therefore, the Writ Petition stands dismissed.
