Hon’ble Shri Bibhu Datta Guru, Judge Order on Board 08/05/2025 Heard.
1. By the present writ petition, the petitioner is questioning the interim order passed by the Commissioner, Surguja dated 06.02.2025, in the appeal filed by the respondent No. 4 before him.
2. Learned counsel for the petitioner submits, that the appeal has been filed by respondent No. 4, against the order of the Collector dated 05.02.2025 which was in favour of the petitioner. He further submits that after filling of the appeal, the Commissioner has ordered for status quo on 06.02.2025 and till date no substantial proceedings has been done by the appellate authority. Hence, the petitioner is seeking a limited direction towards the respondent/ Commissioner to decide the appeal filed by respondent No. 4 before him.
3. Learned State counsel submits that there is no objection to the limited prayer made by the petitioner and if the appeal filled by respondent No. 4, is still pending before the Commissioner, the same will be decided, within a period of 60 days in accordance with law.

4. I have heard learned counsel for the parties and perused the documents.
5. Considering the submission made by learned State counsel, the writ petition is disposed off, with a direction to respondent No. 2 to decide the appeal filed by respondent No.4 within a period of 60 days, from the date of receipt of a copy of this order, in accordance with law.
6. With the aforesaid observation, the writ petition is disposed off. Sd/-
